The Buyer’s details (name, delivery address, billing address, phone, email) are those entered by the Buyer when ordering and are shown in the order summary below.
2. Subject
This agreement sets out the rights and obligations of the parties regarding the sale and delivery of the products described below, ordered by the Buyer using means of distance communication, namely by the email generated from the cart on the Seller’s website or by phone.
3. Product details and order summary
{{SİPARİŞ ÖZETİ}}
The order summary includes at least: product name and key features, quantity, prices including taxes, shipping and other costs, payment method, addresses, order date and number.
For orders created with the Build Your Board tool, the components selected by the Buyer (deck, trucks, wheels, bearings, griptape, assembly option) are listed separately in the order summary.
4. Payment
- Payment is made by bank transfer / EFT to the bank account stated by the Seller in the order confirmation, after the Seller has confirmed the order by email and the Buyer has approved the Pre-Information Form and this agreement. Please include the order number in the payment reference.
- Orders are prepared once payment has reached the Seller’s account.
- If payment cannot be collected for any reason, the Seller is released from its obligation to deliver.
5. Delivery
- Delivery is made only to addresses in Turkey. The product is delivered by the Seller’s contracted courier companies to the delivery address given by the Buyer.
- The product is handed to the courier within 1–3 business days of payment reaching the Seller’s account; complete skateboards and assembled orders created with Build Your Board are handed over within 2–4 business days due to assembly and inspection. After dispatch, delivery usually takes 2–5 business days. In any case, these periods may not exceed the statutory maximum of 30 days from the Seller’s receipt of the order.
- If the Seller fails to fulfil the order within this period, the Buyer may terminate the agreement. If fulfilment becomes impossible, the Seller informs the Buyer within 3 days of learning of this and refunds all amounts paid within 14 days at the latest.
- Shipping fee: free for orders of 1,000 ₺ or more; a flat 129 ₺ for orders below this amount. The applicable shipping fee is shown in the order summary.
- The Buyer should check the parcel on delivery and either have the courier record any damage in a report or refuse delivery. This does not affect the Buyer’s statutory rights regarding defective goods.
- We currently do not ship outside Turkey. Requests from abroad are assessed individually by email; if accepted, customs duties and import costs are borne by the Buyer and the shipping terms are confirmed in writing before the order.
6. Right of withdrawal
- The Buyer may withdraw from the agreement within 14 days from the day of receiving the product, without giving a reason and without paying any penalty. If several products are delivered separately, the period starts on the day the last product is received. The Buyer may also withdraw between the conclusion of the agreement and delivery.
- Notice of withdrawal can be given in writing or on a durable medium, before the period expires, to contact@launchontofi.com or Kocaoba Cumhuriyet Caddesi 2A, 35980 Dikili / İzmir, Türkiye.
- The Buyer returns the product to the Seller within 10 days of the withdrawal notice. Return shipping on withdrawal is free: the Seller provides a return code for its contracted courier company. If the product is returned with the carrier designated by the Seller, the Buyer cannot be charged return costs.
- The Seller refunds all payments received, including delivery costs, within 14 days at the latest of receiving the withdrawal notice, using the payment method the Buyer used (for bank transfer / EFT payments, to the bank account provided by the Buyer) and without charging the Buyer any fee.
- The Buyer is not liable for changes and deterioration resulting from using the product in line with its operation, technical specifications and instructions during the withdrawal period. The Buyer may be liable for loss of value caused by use beyond this.
- Products returned under the right of withdrawal must be unused, in their original packaging and complete. Decks with griptape applied or that have been ridden, and ridden skateboards and scooters, are treated as used beyond what is needed to inspect and try the product; withdrawal returns are not accepted for them. This does not affect the Buyer’s rights regarding defective goods.
7. Exceptions to the right of withdrawal
Under Article 15 of the Distance Contracts Regulation, among other cases, the right of withdrawal does not apply to:
- Goods prepared in line with the consumer’s requests or personal needs,
- Goods whose protective packaging, tape, seal or package has been opened and which are unsuitable for return for health or hygiene reasons,
- Goods which, after delivery, are by their nature inseparably mixed with other items.
In particular:
- Boards created with Build Your Board: As they are prepared from the components selected by the Buyer and assembled according to the Buyer’s choices, they qualify as goods prepared in line with the consumer’s personal needs under Article 15(1)(ç) of the Distance Contracts Regulation, and the right of withdrawal may not apply to these orders. The Buyer is informed of this separately before ordering. The Buyer’s statutory rights in case of defects or assembly errors always remain, and the related costs are borne by the Seller.
- Helmets, protective gear and textiles: For hygiene reasons, they can be returned under the right of withdrawal only if the hygiene seal, tape or packaging has not been opened.
8. Defective goods
If the product is defective, the Buyer may choose one of the rights under Article 11 of Law No. 6502: withdrawal from the contract, a price reduction proportionate to the defect, free repair, or replacement with a non-defective equivalent. Unless a longer period is agreed, liability for defective goods is subject to a 2-year limitation period from delivery. The Seller provides a 2-year statutory warranty against manufacturing defects. Decks broken during tricks, normal wear of parts such as wheels, bearings and griptape, damage from falls and impacts, and faults caused by incorrect assembly by the Buyer are not covered. For defective products, shipping and return costs are borne by the Seller.
9. General obligations
- The Seller delivers the product complete, in line with the order and with any user manual.
- The Buyer confirms that the information provided when ordering is accurate and current.
- For orders placed by email, WhatsApp or phone, before requesting payment the Seller sends the Pre-Information Form and this agreement, completed with the order details, to the Buyer by email (a durable medium). The Buyer confirms by email having read and accepted them; the agreement is concluded with this confirmation.
- After the agreement is concluded, and at the latest before delivery, the Seller also confirms the agreement text to the Buyer on a durable medium.
10. Personal data
The Buyer’s personal data is processed to conclude and perform this agreement in accordance with the Privacy Notice (KVKK).
11. Dispute resolution
- Disputes arising from this agreement fall, within the monetary limits determined annually by the Ministry of Trade, under the jurisdiction of the Consumer Arbitration Committee at the Buyer’s place of residence or where the consumer transaction took place.
- Disputes above those limits fall under the jurisdiction of the Consumer Courts at the Buyer’s place of residence or where the consumer transaction took place. Where required by law, applying to mediation is a precondition for filing a lawsuit.
- The Seller currently sells and delivers only within Turkey.
